Privacy Policy

1. Introduction

FlumeLogic ("we", "us" or "our"), a California Limited Liability corporation, provides this Notice to inform you of our practices regarding personally identifiable information ("PII") that may be collected in connection with your use of the FlumeLogic application and the FlumeLogic.com website.

Your access to and use of the Application is conditional upon your acceptance of and compliance with this Privacy Policy. This Privacy Policy applies to everyone, including visitors, users, and others who wish to access or use the Application.

All personal information you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

By accessing or using the Application, you agree to be bound by this Privacy Policy. If you disagree with any part of the Privacy Policy, you do not have our permission to access or use the Application.

As a user of the Application, you are entitled to know the following:

  • The nature of personally identifiable information we collect;
  • The nature of the use of personally identifiable information;
  • Under what conditions and circumstances we may disclose personally identifiable information and to whom;
  • The period during which we maintain personally identifiable information; and
  • The times and places at which you may have access to your personally identifiable information.

Personally identifiable information or "PII" is information that identifies a particular person; it does not include aggregate data that does not identify a particular person.

2. Collection of PII

This Notice concerns personally identifiable information that you have furnished to us, or that we have collected in connection with the Application.

We collect and store any and all information that you enter on this Application. We may collect the following personally identifiable information for the following purposes:

Name To provide customer service and support to you.

Phone number To provide the service; specifically, to send notifications to you if you choose to enable them.
Device identifiers To provide the service; specifically, to send push notifications to you if you enable them.
FaceID / Biometric access To provide the service; specifically, to allow you to log in without a password if supported by your mobile device and if you choose to enable this feature.
Parcel data; Farm Crop report with field size (acres) and location To provide the service; specifically to identify via satellite imagery the specific fields, and number and location of drain boxes within each field.
Gate codes, disclosed field hazards To provide the service; specifically to access the field locations to install and maintain our Equipment (Gateway and Sensors).
Geolocation of field, drain box, water-level sensor To provide the service; specifically, to show a map view of your field, if you choose to enable location services.
Size of field (acres), planting date, crop variety To provide the service; specifically, to provide you with accurate data about your crop growth stage.
Information about your use of the app To provide support to you. To debug and optimize the app for you.
Water level data To provide the service; specifically, to allow you to remotely monitor your field water level.
Contact form submissions (name, phone/email, message) To respond to inquiries submitted via the FlumeLogic.com website contact form.

Other purposes for which we may collect PII:

  • To obtain information necessary to allow you to use the App or other services we provide;
  • To customize, measure, and improve the App and the content, features, and advertising provided through the App;
  • To enforce our service terms and to detect fraud and other illegal activities;
  • To bill and collect for any applicable charges or fees;
  • To provide customer service and technical support to you for performance, configuration, usage, management, and troubleshooting of the App;
  • To let you know about new apps, products, or services from us;
  • To let you know about legal changes, including changes to this Notice and other applicable terms; and
  • To update any hardware, software, or other tools we provide in conjunction with the App or other services.

Except as provided in this Notice, we do not use the Application to collect PII for any purposes other than those listed above without the user's prior written or electronic consent.

3. Disclosure of PII

We consider the personally identifiable information contained in our business records to be confidential. We may disclose personally identifiable information concerning any user if the disclosure is:

  • Necessary to render, or conduct a legitimate business activity related to the App or other services provided by us to the user;
  • Required by law or legal process; or
  • Of the names and email addresses of users for "mailing list" or other purposes (subject to each user's right to prohibit or limit this disclosure).

We do not disclose personally identifiable information concerning any user for any purposes other than those listed above without the user's prior written or electronic consent.

We may sometimes disclose personally identifiable information about you to third parties such as customer management systems, data analytics providers, and operating systems and platforms for the purposes of providing customer support, managing interactions with you, ensuring quality of service, analyzing your interactions with the Application, and allowing you to submit feedback to us.

We may sometimes disclose personally identifiable information to our affiliates or others who work for us, including outside auditors, professional advisors, service providers, vendors, potential merger or acquisition partners, and regulators. We may be required by law or legal process to disclose certain personally identifiable information to lawyers and parties in connection with litigation and to law enforcement personnel.

We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). For more information, please refer to Google's Privacy Policy.

Protection of PII. We follow industry-standard practices to prevent unauthorized access to personally identifiable information. However, we cannot guarantee that these practices will prevent every unauthorized attempt to access, use, or disclose personally identifiable information.

Retention of PII. We maintain PII about you in our regular business records while you are a user of the Application and other services. We also maintain this information for a period of time after you are no longer a user if the information is necessary for the purposes for which it was collected or to satisfy legal requirements. These purposes typically include business, legal, or tax purposes.

5. Sale of Your Information

We do not sell your PII.

6. Cookies

A cookie is a small piece of data sent from a website or application and stored on your computer or device by your web browser. The Application does not collect cookies.

Do Not Track Features

Most web browsers and some mobile operating systems and applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you in a revised version of this privacy notice.

7. Specific Privacy Rights for California Residents

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. To make such a request, please submit it in writing to us using the contact information provided below.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Application, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. CCPA Privacy Notice

The California Code of Regulations defines a "resident" as:

  1. Every individual who is in the State of California for other than a temporary or transitory purpose; and
  2. Every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose.

All other individuals are defined as "non-residents."

If this definition of "resident" applies to you, we must adhere to certain rights and obligations regarding your personal information.

We will use and retain the collected personal information as needed to provide the Services, or for:

  • Category A — 12 months past the termination of the user's account.
  • Category B — 12 months past the termination of the user's account.
  • Category G — While using the application.

8. Customer Access and Choice

All users of the Application have the following rights with respect to their PII:

  • The right to access your information.
  • The right to say no to the sale of your personal information.
  • The right to request that we delete all or some of the personal information that we have collected on you.
  • The right to request that we amend any of the information that we have collected about you.
  • The right to withdraw your consent to the processing of your data.
  • The right to request that we restrict the processing of your data.
  • The right to lodge a complaint regarding our collection, sharing, and processing of data.
  • The right to stop receiving unwarranted direct marketing.

You may exercise the rights specified above by submitting a consumer request to the address listed in this Notice. We will need to verify your identity prior to effectuating your request. We will respond to most consumer requests within 15 days of receipt.

Changes to Privacy Notice. We may modify this notice at any time. We will notify you of any material changes through written, electronic, or other means as permitted by law. If you find the changes unacceptable, you have the right to cancel your service. Continued use of the service following notice of changes constitutes acceptance of and consent to those changes.
